Bilibili Sued by Chinese Basketball Association for Copyright Infringement

China's leading basketball association has recently initiated a copyright infringement lawsuit agnst streaming giant Bilibili, demanding compensation of approximately $60.12 million 406 million yuan for unauthorized online broadcasts during the 2019-2020 season.

In an official filing from Beijing High People’s Court earlier this month, the Chinese Basketball Association accused Bilibili of infringing on its intellectual property by streaming basketball games without permission throughout the 2019-2020 season. The court alleged that Bilibili encouraged video bloggers to upload these games through various schemes connected to their activities on the platform.

Specifically, Bilibili set up designated tabs, channels, and rankings on its website for CBA-related content. This was deemed a direct and deliberate act of infringement by Beijing Court's filing. It is further clmed that this platform facilitated the unauthorized broadcast of sports events through schemes that influenced bloggers' creative activities.

The lawsuit also accused Bilibili of violating China's Anti-Unfr Competition Law, as it allegedly gned a competitive advantage in the market by leveraging the unauthorised streaming of sports events.

Bilibili had previously been authorized to stream CBA games during the league's 2017-2018 and 2018-2019 seasons. However, for the 2019-2020 season, these rights were transferred to Migu Video, a subsidiary of China Mobile; Tencent Video from Tencent Holdings; and Youku, owned by Alibaba Group Holding - according to both the court filing and relevant news reports.

This lawsuit underscores the ongoing legal battle in China's digital media landscape regarding copyright infringement in sports broadcasting.
